Unlawful possession of marijuana in the 2nd degree
This charge applies to possession of marijuana for personal use only. It is up to the investigators discretion to determine whether or not the marijuana was used for personal use.
Fine up to $6,000 Imprisonment : Up to 1 Year
Unlawful possession or sale of drug paraphernalia
This charge applies to the possession or sale of any equipment that is used to produce, conceal, and consume illicit drugs. It includes but is not limited to items such as bongs, roach clips, miniature spoons, and various types of pipes
Fine: Up to $6,000 Imprisonment : Up to 1 Year
Felonies
Unlawful possession of marijuana in the 1st degree
(1) Possession of marijuana for other than personal use; or
(2) Possession of marijuana for personal use after at least one prior conviction for unlawful possession of marijuana.
Fine: Up to $15,000Imprisonment: 1 to 10 years
Additional penalty if sale is on or near school campus or public housing project
If the sale of marijuana was on a campus or public housing project or within a three-mile radius of the campus, any public or private school, college, university or other educational institution in this state or within a three-mile radius of public housing project boundaries
Fine: N/A Imprisonment: 5 years additional
Unlawful sale of drug paraphernalia to a person under the age of 18
This charge applies to the sale of any equipment that is used to produce, conceal, and consume illicit drugs to a person under the age of 18. It includes but is not limited to items such as bongs, roach clips, miniature spoons, and various types of pipes.
Fine: Up to $30,000 Imprisonment: 2 to 20 years
Trafficking of marijuana
Any person who knowingly sells, manufactures, delivers, or brings into this state, or who is knowingly in actual or constructive possession of, in excess of 2.2 pounds of marijuana.
Greater than 2.2 pounds, but less than 100 pounds
Fine: $25,000 Imprisonment: MMI of 3 years
Greater than 100 pounds, but less than 500 pounds
Fine: $50,000 Imprisonment: MMI of 5 years
Greater than 500 pounds, but less than 1,000 pounds
Fine: $200,000 Imprisonment: MMI of 15 years
Greater than 1,000 pounds
Fine: N/A Imprisonment: MMI Life in prison
