Involving an amount of marijuana not possessed for sale having a weight of 2 to 4 pounds (class 5 felony).

  Involving an amount of marijuana not possessed for sale having a weight of more than 4 pounds (class 4 felony).

Additional penalty if possession/sale is on or near school campus

 

If the possession of any amount of marijuana was on or near a campus, any public or private school, college, university or other educational institution in this state.

Involving the sale of marijuana with a weight of less than 2 pounds (class 4 felony).

Unlawful possession or sale of drug paraphernalia

 

This charge applies to the possession or sale of any equipment that is used to produce, conceal, and consume illicit drugs. It includes but is not limited to items such as bongs, roach clips, miniature spoons, and various types of pipes (class 5 felony).

  Fine: Up to $150,000                           Imprisonment: Up to 1.5 year

Note: Depending on extenuating circumstances, some of the above felonies may be charged as misdemeanors.
