Misdemeanors

  Unlawful possession of marijuana
 

Any person who possesses one ounce or less of marijuana.  This will be charged as promoting a detrimental drug in the 3rd degree (petty misdemeanor).

 

Fine: Up to $1,000                                           Imprisonment: Up to 30 days

   
  Unlawful possession of marijuana
 

Any person who possesses one ounce or more of marijuana.  This will be charged as promoting a detrimental drug in the 2nd degree (petty misdemeanor).

 

Fine: Up to $2,000                                           Imprisonment: Up to 1 year

   
  Unlawful sale of marijuana
 

Involving the sale of less than one ounce of marijuana.  This will be charged as promoting a detrimental drug in the 2nd degree (petty misdemeanor).

 

Fine: Up to $2,000                                           Imprisonment: Up to 1 year

 

 

 

Felonies

 

 

  Unlawful possession of marijuana
 

Any person who possesses 2 to 25 pounds of marijuana.  A person commits the offense of commercial promotion of marijuana in the second degree (class B felony).

 

Fine: Up to $25,000                                         Imprisonment: Up to 10 years

 

 

  Unlawful possession of marijuana
 

Any person who possesses 25 pounds or more of marijuana.  A person commits the offense of commercial promotion of marijuana in the first degree (class A felony).

  Fine: Up to $50,000                                         Imprisonment: Up to 20 years
 

 

  Trafficking of marijuana
 

Any person who distributes marijuana having an aggregate weight of one pound or more or who possesses, cultivates, or has under the person's control fifty or more marijuana plants commits the offense of commercial promotion of marijuana in the second degree (class B felony).

 

Fine: $25,000                                                   Imprisonment: Up to 10 years

   
  Trafficking of marijuana
 

Any person who distributes marijuana having an aggregate weight of five pounds or more or who possesses, cultivates, or has under the person's control one hundred or more marijuana plants commits the offense of commercial promotion of marijuana in the first degree (class A felony).

 

Fine: Up to $50,000                                         Imprisonment: Up to 20 years

 

 

  Sale to Minor
 

Unlawful sale of marijuana

 

Involving the sale of any amount of marijuana from any person to any minor commits the offense of commercial promotion of marijuana in the second degree (class B felony).

  Fine: $25,000                                                   Imprisonment: Up to 10 years
