The graphs below represents how lenient or strict the marijuana laws are in your state compared to Maine, Hawaii, and Connecticut.  This determination is based on level of enforcement, weight limits, fines and/or time imprisoned.  This determination is also based on how strict penalties are for repeat offenders and proximity to certain drug restricted areas such as school zones and public parks.

Misdemeanors

 

Unlawful possession of marijuana (less than 2.5 grams)

 

Any person who possesses less than 2.5 grams of marijuana (class C Misdemeanor).

 

Fine: Up to $1,500                                           Imprisonment: Up to 30 days

   
  Unlawful possession of marijuana (2.5 to 10 grams)
 

Any person who possesses between 2.5 to 10 grams of marijuana (class B Misdemeanor).

 

Fine: Up to $1,500                                           Imprisonment: Up to 6 months

   
  Sale/Delivery of marijuana
 

Any person who knowingly manufactures, delivers, or possesses with intent to deliver, or manufactures marijuana in the amount of 2.5 grams or less (Class B misdemeanor).

 

Fine: Up to $1,500                                           Imprisonment: Up to 6 months

 

 

 

On or within 1,000 feet of school grounds (Class A misdemeanor):
Fine: Up to $2,500                                           Imprisonment: Up to 1 year

   
 

Cultivation of Marijuana (Less than 5 plants)

 
Any person who knowingly produces 5 plants or less of the marijuana sativa plant or who possesses such plants unless production or possession has been authorized (Class A misdemeanor).
  Fine: Up to $2,500                                           Imprisonment: Up to 1 year
   
 

Unlawful possession of marijuana (10-30 grams)

 

Any person who possesses between 10 to 30 grams of marijuana (class A misdemeanor).

 

Fine: Up to $2,500                                           Imprisonment: Up to 1 year

   
  Casual Delivery of marijuana
 

Any person who delivers not more than 10 grams of any substance containing marijuana without monetary exchange will be charged as a possession offense.

 

 

 

Felonies

  Unlawful possession of marijuana (30-500 grams)
 

Any person who possesses between 30 to 500 grams of marijuana (class 4 Felony).

 

Fine: $25,000 or more                                      Imprisonment: 1 to 3 years

 
 

Unlawful possession of marijuana (500-2,000 grams)

 

Any person who possesses between 500 to 2,000 grams of marijuana (class 3 Felony).

 

Fine: $25,000 or more                                      Imprisonment: 2 to 5 years

   
  Unlawful possession of marijuana (2,000-5,000 grams)
  Any person who possesses between 2,000 to 5,000 grams of marijuana (class 2 Felony).
 

Fine: $25,000 or more                                      Imprisonment: 3 to 7 years

   
 

Unlawful possession of marijuana (5,000+ grams)

 

Any person who possesses more than 5,000 grams of marijuana (class 1 Felony).

 

Fine: $25,000 or more                                      Imprisonment: 4 to 15 years

   
 

Trafficking of marijuana

 

Any person who knowingly brings or causes to be brought into this State for the purpose of manufacture or delivery or with the intent to manufacture or deliver 2,500 grams or more of marijuana in this State or any other state or country is guilty of trafficking.

Sale/Delivery of marijuana (2.5 to 10 grams)

 

2.5 to 10 Any person who knowingly manufactures, delivers, or possesses with intent to deliver, or manufactures marijuana in the amount of 2.5 to 10 grams (Class A misdemeanor).

 

Fine: Up to $2,500                                           Imprisonment: Up to 1 year

   
 

On or within 1,000 feet of school grounds (Class 4 Felony):

 

Fine: $25,000 or more                                      Imprisonment: 1 to 3 years

   
 

Sale/Delivery of marijuana (10 grams to 30 grams)

 

Any person who knowingly manufactures, delivers, or possesses with intent to deliver, or manufactures marijuana in the amount of 10 to 30 grams (Class 4 Felony).

 

Fine: $25,000 or more                                      Imprisonment: 1 to 3 years

   
 

On or within 1,000 feet of school grounds (Class 3 Felony):

 

Fine: $25,000 or more                                      Imprisonment: 2 to 5 years

Any person who knowingly manufactures, delivers, or possesses with intent to deliver, or manufactures marijuana in the amount of 500 to 2000 grams (Class 2 Felony).

 

Fine: $25,000 or more                                      Imprisonment: 3 to 7 years

   
 

On or within 1,000 feet of school grounds (Class 1 Felony):

 

Fine: $25,000 or more                                      Imprisonment: 4 to 15 years

   
 

Sale/Delivery of marijuana (2,000-5,000 grams)

 

Any person who knowingly manufactures, delivers, or possesses with intent to deliver, or manufactures marijuana in the amount of 2,000 to 5,000 grams (Class 1 Felony).

 

Fine: $25,000 or more                                      Imprisonment: 4 to 15 years

   
 

Sale/Delivery of marijuana (5,000+ grams)

 

Any person who knowingly manufactures, delivers, or possesses with intent to deliver, or manufactures marijuana in the amount of 5,000 grams or more (Class X felony).

 

Fine: $25,000 or more                                      Imprisonment: 6 to 30 years

   
 

Sale to Minor

 

Any person who is at least 18 years of age who delivers marijuana to a person under 18 years of age who is at least 3 years his junior may be sentenced to imprisonment for a term up to twice the maximum term.

 

Fine: Doubled                                                   Imprisonment: Doubled

   
 

Cultivation of Marijuana (6 to 20 plants)

 

Any person who knowingly produces 6 to 20 plants of the marijuana sativa plant or who possesses such plants unless production or possession has been authorized (Class 4 felony).

 

Fine: $25,000 or more                                      Imprisonment: 1 to 3 years

   
 

Cultivation of Marijuana (21 to 50 plants)

 

Any person who knowingly produces 21 to 50 plants of the marijuana sativa plant or who possesses such plants unless production or possession has been authorized (Class 3 felony).

 

Fine: $25,000 or more                                      Imprisonment: 2 to 5 years

   
 

Cultivation of Marijuana (51 to 200)

 

Any person who knowingly produces 51 to 200 plants of the marijuana sativa plant or who possesses such plants unless production or possession has been authorized (Class 2 felony).

 

Fine: $25,000 or more                                      Imprisonment: 3 to 7 years

   
 

Cultivation of Marijuana (201 plants or more)

 

Any person who knowingly produces 201 plants or more of the marijuana sativa plant or who possesses such plants unless production or possession has been authorized (Class 1 felony).

 

Fine: $25,000 or more                                      Imprisonment: 4 to 15 years

   
 

Note:

 

Subsequent offenses result in much harsher fines and/or penalties than noted for this state.
