Unlawful possession of drug paraphernalia
A person who possesses a raw material, an instrument, a device, or other object that the person intends to use for:
(1) introducing into the person's body a controlled substance;
(2) testing the strength, effectiveness, or purity of a controlled substance; or
(3) enhancing the effect of a controlled substance.
Fine: Up to $500 Imprisonment: None
Misdemeanors
Unlawful possession of marijuana (30 grams or less)
Any person who possesses 30 grams or less of marijuana.
Fine: Up to $5,000 Imprisonment: Up to 1 year
Sale/Manufacturing of marijuana (less than 30 grams)
Any person who knowingly or intentionally manufactures, finances the manufacture of, delivers, or finances the delivery of possesses with the intent to commit any of the above in the amount of less than 30 grams of marijuana.
Fine: Up to $5,000 Imprisonment: Up to 1 year
Unlawful possession of drug paraphernalia (reckless possession)
Any person who recklessly possesses a raw material, an instrument, a device, or other object that is to be used primarily for:
(1) introducing into the person's body a controlled substance;
(2) testing the strength, effectiveness, or purity of a controlled substance; or
(3) enhancing the effect of a controlled substance.
Fine: Up to $1,000 Imprisonment: Up to 180 days
Sale of drug paraphernalia
A person who keeps for sale, offers for sale, delivers, or finances the delivery of a raw material, an instrument, a device, or other object that is intended to be or that is designed or marketed as drug paraphernalia that is to be used primarily for:
(1) introducing into the person's body a controlled substance;
(2) testing the strength, effectiveness, or purity of a controlled substance; or
(3) enhancing the effect of a controlled substance.
Fine: Up to $5,000 Imprisonment: Up to 1 year
Sale of drug paraphernalia (reckless sale)
A person who recklessly keeps for sale, offers for sale, delivers, or finances the delivery of a raw material, an instrument, a device, or other object that is intended to be or that is designed or marketed as drug paraphernalia that is to be used primarily for:
(1) introducing into the person's body a controlled substance;
(2) testing the strength, effectiveness, or purity of a controlled substance; or
(3) enhancing the effect of a controlled substance.
Fine: Up to $1,000 Imprisonment: Up to 180 days
Felonies
Unlawful possession of marijuana (more than 30 grams)
Any person who possesses more than 30 grams of marijuana. A person who commits a class D felony shall be imprisoned for a fixed term of one and one-half years, with not more than one and one-half years added for aggravating circumstances or not more than one year subtracted for mitigating circumstances.
Fine: Up to $10,000 Imprisonment: 6 months to 3 years
Sale/Manufacturing of marijuana (30 grams to 10 pounds)
Any person who knowingly or intentionally manufactures, finances the manufacture of, delivers, or finances the delivery of possesses with the intent to commit any of the above in the amount 30 grams to 10 pounds of marijuana.
Fine: Up to $10,000 Imprisonment: 6 months to 3 years
Sale/Manufacturing of marijuana (10 pounds or more)
Any person who knowingly or intentionally manufactures, finances the manufacture of, delivers, or finances the delivery of possesses with the intent to commit any of the above in the amount 10 pounds or more of marijuana.
Fine: Up to $10,000 Imprisonment: 2 to 8 years
Sale to Minor
Unlawful sale of marijuana
Involving the sale of any amount of marijuana to any recipient less than 18 years of age.
Fine: Up to $10,000 Imprisonment: 6 months to 3 years
Sale in restricted area
The sale of any amount of marijuana on a school bus, or in, on, or within one thousand feet of school property, a public park, a family housing complex, or a youth program center.
Fine: Up to $10,000 Imprisonment: 2 to 8 years
Unlawful possession of drug paraphernalia
This charge applies to the possession of any equipment that is used to produce, conceal, and consume illicit drugs. It includes but is not limited to items such as bongs, roach clips, miniature spoons, and various types of pipes.
Fine: Up to $1000 Imprisonment: Up to 1 year
Unlawful possession of drug paraphernalia (reckless possession)
Any person with a prior judgment or conviction against them who recklessly possesses a raw material, an instrument, a device, or other object that is to be used primarily for:
(1) introducing into the person's body a controlled substance;
(2) testing the strength, effectiveness, or purity of a controlled substance; or
(3) enhancing the effect of a controlled substance;
Fine: Up to $10,000 Imprisonment: 6 months to 3 years
Sale of drug paraphernalia (2nd offense)
A person with a prior judgment against them who keeps for sale, offers for sale, delivers, or finances the delivery of a raw material, an instrument, a device, or other object that is intended to be or that is designed or marketed as drug paraphernalia that is to be used primarily for:
(1) introducing into the person's body a controlled substance;
(2) testing the strength, effectiveness, or purity of a controlled substance; or
(3) enhancing the effect of a controlled substance.
Fine: Up to $10,000 Imprisonment: 6 months to 3 years

A person with a prior judgment who recklessly keeps for sale, offers for sale, delivers, or finances the delivery of a raw material, an instrument, a device, or other object that is intended to be or that is designed or marketed as drug paraphernalia that is to be used primarily for:
(1) introducing into the person's body a controlled substance;
(2) testing the strength, effectiveness, or purity of a controlled substance; or
(3) enhancing the effect of a controlled substance.
Fine: Up to $10,000 Imprisonment: 6 months to 3 years
