Misdemeanors

 

Unlawful possession of marijuana (less than 8 ounces)

 

Any person who possesses less than 8 ounces of marijuana (Class A misdemeanor).

Cultivation of Marijuana (Less than 5 plants

 

A person is guilty of marijuana cultivation when he knowingly and unlawfully plants, cultivates, or harvests marijuana with the intent to sell or transfer it (Class A misdemeanor).
Fine: Up to $500                             Imprisonment: Up to 1 year

   
 

Trafficking of marijuana

 

A person is guilty of trafficking in marijuana when he knowingly and unlawfully traffics less than 8 ounces of marijuana (class A misdemeanor).

  Fine: Up to $500                                   Imprisonment: Up to 1 year
 

 

 

Possession of drug paraphernali

 

Any drug paraphernalia to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, repack, sell or distribute a controlled substance (Class A misdemeanor).

  Fine: Up to $500                                   Imprisonment: Up to 1 year
   
 

Note: The unlawful possession by any person of eight (8) or more ounces of marijuanashall be prima facie evidence that the person possessed the marijuana with the intent to sell or transfer it.

 
 

Felonies

Trafficking of marijuana (5 pounds or more-2nd or subsequent offense)

  A person is guilty of trafficking in marijuana when he knowingly and unlawfully traffics 5 pounds or more of marijuana (Class B Felony).
 

Fine: $1,000 to $10,000                                   Imprisonment: 10 to 20 years

   
 

Unlawful transaction with a minor

 

A person is guilty of unlawful transaction with a minor in the second degree when they knowingly induce, assist, or cause a minor to engage in illegal controlled substance activity involving marijuana (Class D felony).

 

Fine: $1,000 to $10,000                                   Imprisonment: 1 to 5 years
