Unlawful possession of marijuana
Any person who possesses any amount of marijuana.
Fine: Up to $100 Imprisonment: Up to 90 days
Unlawful possession of marijuana (restricted area)
Any person who possesses any amount of marijuana on or within 1,000 feet of school property or a library. Fine: Up to $2,000 Imprisonment: Up to 2 years
Distribution of marijuana (without monetary exchange)
A person who distributes marijuana without remuneration and not to further commercial distribution. Fine: Up to $1,000 Imprisonment: Up to 1 year
Sale of drug paraphernalia
The sale of any drug paraphernalia used to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, repack, sell or distribute any marijuana. Fine: Up to $5,000 Imprisonment: Up to 90 days
Sale of drug paraphernalia to a minor
Any person 18 years of age or older who violates section 7453 by selling or offering to sell drug paraphernalia to a person less than 18 years of age. Fine: Up to $7,500 Imprisonment: Up to 1 year
Felonies
Delivery/Manufacturing of marijuana
Delivery or manufacture of less than 5 kilograms or 20 plants of marijuana.
Fine: Up to $20,000 Imprisonment: Up to 4 years
Delivery or manufacture of 5 or more but less than 45 kilograms of marijuana. Fine: Up to $500,000 Imprisonment: Up to 7 years
Delivery or manufacture of 45 or more kilograms of marijuana. Fine: $500 to $10,000 Imprisonment: MMI 1 year 2.5 to 15 years
