The possession of any drug paraphernalia used to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, repack, sell or distribute any marijuana.

Unlawful sale of drug paraphernalia to a minor (gross misdemeanor)
Any person 18 years of age or older who violates section 152.093 by knowingly or intentionally delivering drug paraphernalia to a person under 18 years of age who is at least three years younger is guilty of a gross misdemeanor.

Any person who possesses 42.5 grams or less of marijuana.

Any person who distributes 42.5 g or less of marijuana without remuneration and not to further commercial distribution.

Unlawful possession of marijuana
Any person who possesses 42.5 g to 10 kg of marijuana.
Fine: Up to $10,000 Imprisonment: Up to 5 years
Any person who possesses 10 g to 50 kg of marijuana. Fine: Up to $250,000 Imprisonment: Up to 20 years
Any person who possesses 50 kg to 100 kg of marijuana. Fine: Up to $500,000 Imprisonment: Up to 25 years
Any person who possesses greater than 100 kg of marijuana Fine: Up to $1,000,000 Imprisonment: Up to 30 years
Unlawful sale of marijuana
Any person who sells less than 5 kg of marijuana.
Fine: Up to $10,000 Imprisonment: Up to 5 years
Any person who sells 5 kg to 25 kg of marijuana.
Fine: Up to $250,000 Imprisonment: Up to 20 years
Any person who sells 25 kg to 50 kg of marijuana.
Fine: Up to $500,000 Imprisonment: Up to 25 years
Any person who sells more than 50 kg of marijuana.
Fine: Up to $1,000,000 Imprisonment: Up to 30 years
