Unlawful possession of marijuana
Any person who possesses 35 grams or less of marijuana (class A misdemeanor). Fine: Up to $1,000 Imprisonment: Up to 1 year
Unlawful use of drug paraphernalia
It is unlawful for any person to use, or to possess with intent to use, drug paraphernalia to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, repack, store, contain, conceal, inject, ingest, inhale, or otherwise introduce into the human body any amount of marijuana (class A misdemeanor). Fine: Up to $1,000 Imprisonment: Up to 1 year

Unlawful possession of marijuana
Any person who possesses 35 grams to 30 kg of marijuana (class C felony). Fine: Up to $5,000 Imprisonment: Up to 7 years
Unlawful possession/trafficking of marijuana
Any person who possesses 30 kg to 100 kg of marijuana commits the crime of trafficking drugs in the second degree (class B felony). Fine: $5,000 to $20,000 Imprisonment: 5 to 15 years
Any person who possesses 1 kg to 5 kg of marijuana. Fine: Up to $500,000 Imprisonment: 6 to 24 years
Unlawful possession of marijuana to minor
Any person who possesses more than 100 kg of marijuana commits the crime of trafficking drugs in the second degree (class A felony).
Fine: $5,000 to $20,000 Imprisonment: 10 years to life
Unlawful sale of marijuana
Any person who distributes or delivers not more than 5grams of marijuana (class C felony). Fine: Up to $5,000 Imprisonment: Up to 7 years
Any person who sells 5 kg to 25 kg of marijuana.

Any person who distributes or delivers more than 100 kg of marijuana commits the crime of trafficking drugs in the first degree if he distributes, delivers, manufactures, or produces a mixture or substance containing marijuana (class A felony) which term shall be served without probation or parole. Unlawful cultivation/trafficking of marijuana
A person commits the class A felony of trafficking drugs in the second degree if, they possess or have under their control, purchase or attempt to purchase, or bring into this state more than five hundred marijuana plants (Class A felony). Fine: $5,000 to $20,000 Imprisonment: 10 years to life
Unlawful Sale of marijuana to minor
A person commits the offense of unlawful distribution of a controlled substance to a minor by distributing or delivering marijuana to a person under seventeen years of age who is at least two years that person's junior (class B felony). Fine: $5,000 to $20,000 Imprisonment: 5 to 15 years
Unlawful Sale of marijuana near school
A person commits the offense of distribution of a controlled substance near schools if such unlawfully distributes or delivers any marijuana to a person in or on, or within two thousand feet of, the real property comprising a public or private elementary or secondary school, public vocational school, or a public or private junior college, college or university or on any school bus. Distribution of marijuana near schools is a class A felony which term shall be served without probation or parole if the court finds the defendant is a persistent drug offender. Fine: $5,000 to $20,000 Imprisonment: 10 years to life
Unlawful Sale of marijuana near public housing
A person who distributes marijuana on or within 1000 feet of public housing or other governmental assisted housing commits a class A felony which term shall be served without probation or parole if the court finds the defendant is a persistent drug offender. Fine: $5,000 to $20,000 Imprisonment: 10 years to life
Unlawful delivery/manufacturing of drug paraphernalia
It is unlawful for any person to deliver, possess with intent to deliver, or manufacture, with intent to deliver, drug paraphernalia, knowing, or under circumstances where one reasonably should know, that it will be used to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, repack, store, contain, conceal, inject, ingest, inhale, or otherwise introduce into the human body any amount of marijuana (class D felony).
Fine: Up to $5,000 Imprisonment: Up to 4 years
Note: If the offender has gained money or property through the commission of the crime, to pay an amount, fixed by the court, not exceeding double the amount of the offender's gain from the commission of the crime. An individual offender may be fined not more than twenty thousand dollars under this provision.
