Unlawful possession of marijuana
A person who possesses 1 ounce or less of marijuana will be guilty of an infraction, receive a citation, and may be assigned to attend a course if the judge determines that attending such course is in the best interest of the individual defendant. Fine: $100 Imprisonment: None
Unlawful possession/use of drug paraphernalia
It shall be unlawful for any person to use, or to possess with intent to use, drug paraphernalia to manufacture, inject, ingest, inhale, or otherwise introduce into the human body any amount of marijuana. Fine: Up to $100 Imprisonment: None
Misdemeanors
Unlawful possession of marijuana (2nd offense)
For a second offense a person who possesses 1 ounce or less of marijuana will be guilty of a misdemeanor and receive a citation. Fine: $200 Imprisonment: Up to 5 days
Unlawful possession of marijuana (3rd and subsequent offenses)
For third and all subsequent offenses a person who possesses 1 ounce or less of marijuana will be guilty of a misdemeanor and receive a citation. Fine: $300 Imprisonment: Up to 7 days
Unlawful possession of marijuana
A person who possesses 1 ounce to 1 pound of marijuana will be guilty of a misdemeanor and receive a citation. Fine: $500 Imprisonment: Up to 7 days
Sale of drug paraphernalia
It shall be unlawful for any person to deliver, possess with intent to deliver, or manufacture with intent to deliver drug paraphernalia. Fine: Up to $1,000 Imprisonment: Up to 6 months
Felonies
Unlawful possession of marijuana
A person who possesses more than 1 pound of marijuana. Fine: Up to $10,000 Imprisonment: Up to 5 years
Unlawful sale of marijuana
A person who manufactures, distributes, delivers, dispenses, or possesses with intent to manufacture, distribute, deliver, or dispense any amount of marijuana. Fine: Up to $25,000 Imprisonment: MMI 1 year Up to 20 years
Unlawful Sale of marijuana to a minor
Any person 18 years or older who manufactures, distributes, delivers, dispenses, or possesses with intent to manufacture, distribute, deliver, or dispense any amount of marijuana to any person under the age of 18. Fine: Up to $50,000 Imprisonment: MMI 3 years Up to 20 years
Unlawful Sale of marijuana in a restricted area
A person who manufactures, distributes, delivers, dispenses, or possesses with intent to manufacture, distribute, deliver, or dispense any amount of marijuana in, on, or within one thousand feet of the real property comprising a public or private elementary, vocational, or secondary school, a community college, a public or private college, junior college, or university, or a playground, or within one hundred feet of a public or private youth center, public swimming pool, or video arcade facility.
