Unlawful possession of marijuana
A person who possesses less than 100 grams of marijuana.
Fine: Up to $100                                              Imprisonment: None
                   
A person who possesses 100 grams to 200 grams of marijuana.
Fine: Up to $250                                              Imprisonment: Up to 30 days

 

Sale/distribution of marijuana without monetary exchange
A person who sells or distributes 20 grams or less of marijuana for no monetary exchange.
Fine: $100                                                        Imprisonment: None


Unlawful possession/use of drug paraphernalia
It shall be unlawful for any person to use, or to possess with intent to use, drug paraphernalia to manufacture, inject, ingest, inhale, or otherwise introduce into the human body any amount of marijuana.
Fine: Up to $250                                              Imprisonment: Up to 30 days


Unlawful Sale of drug paraphernalia
The sale of any drug paraphernalia used to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, or repack any marijuana.
Fine: Up to $750                                                          Imprisonment: Up to 90 days


Unlawful Sale of drug paraphernalia to a minor
The sale of any drug paraphernalia to a minor used to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, or repack any marijuana.

Fine: Up to $1,000                                                       Imprisonment: Up to 6 months

Unlawful possession of marijuana
A person who possesses 200 grams to 1,000 grams of marijuana.
Fine: Up to $2,500                                           Imprisonment: Up to 1 year


A person who possesses 1,000 grams to 5,000 grams of marijuana.
Fine: Up to $10,000                                         Imprisonment: Up to 5 years


A person who possesses 5,000 grams to 20,000 grams of marijuana.
Fine: Up to $10,000                                         Imprisonment: 1 to 5 years


A person who possesses more than 20,000 grams of marijuana.
Fine: Up to $15,000                                         Imprisonment: MMI 8 years


MMI= Mandatory Minimum Imprisonment


Unlawful sale/trafficking/distribution of marijuana
Any person who knowingly sells, manufactures, delivers or brings into this state less than 200 grams of marijuana.
Fine: Up to $2,500                                           Imprisonment: Up to 1 year


More than 200 grams, but less than 1,000 grams of marijuana.
Fine: Up to $5,000                                           Imprisonment: Up to 18 months


More than 1,000 grams, but less than 5,000 grams of marijuana.
Fine: Up to $10,000                                         Imprisonment: Up to 5 years


More than 5,000 grams, but less than 20,000 grams of marijuana.
Fine: Up to $10,000                                         Imprisonment: 1 to 5 years


More than 20,000 grams of marijuana.
Fine: Up to $15,000                                         Imprisonment: MMI 8 years

Note: Second or subsequent offenses result in much harsher fines and/or penalties than noted for this state.  Sale/distribution of marijuana within a school zone and/or to minors results in much harsher penalties in this state.
