Misdemeanors

 

Unlawful possession of marijuana
A person who possesses any amount of marijuana.
Fine: Up to $10,000                                         Imprisonment: Up to 1 year


Unlawful possession/use of drug paraphernalia

It shall be unlawful for any person to use, or to possess with intent to use, drug paraphernalia to manufacture, inject, ingest, inhale, or otherwise introduce into the human body any amount of marijuana.

Fine: Up to $1,000                                           Imprisonment: Up to 1 year

 

 
 
 

Felonies

 

Unlawful possession of marijuana (2nd offense)
A person who possesses any amount of marijuana with a prior conviction for this offense.
Fine: Up to $20,000                                         Imprisonment: 2 to 10 years


Unlawful possession/sale of marijuana in a restricted area

Any person who possesses, or purchases, or any person who sells marijuana to any person, in or on, or within 1,000 feet of the real property comprising a public or private elementary or secondary school, public vocational school, public or private college or university, or other institution of higher education, recreation center or public park, including state parks and recreation areas, or in the presence of any child under 12 years of age.
Fine: Double                                                     Imprisonment: Double


Unlawful sale of marijuana to minor

Any person, who sells, manufactures, or delivers marijuana to any minor.  Minor means any person under 18 years of age, except such person who is on active duty with or has served in any branch of the Armed Services of the United States shall be considered an adult.
Fine: Double                                                     Imprisonment: Double


Unlawful sale of marijuana          

Any person who knowingly sells, delivers or brings into this State, or who is knowingly in actual or constructive possession of less than 25 pounds of marijuana.
Fine: Up to $20,000                                         Imprisonment: 2 years to life

More than 25 pounds, but less than 1,000 pounds

Fine: $25,000 to $100,000                               Imprisonment: 4 years to life

More than 1,000 pounds
Fine: $100,000 to $500,000                             Imprisonment: 4 years to life


Unlawful cultivation of marijuana

Any person who manufactures or attempts to unlawfully manufacture less than 1,000 kg of marijuana or less than 1,000 marijuana plants.
Fine: Up to $20,000                                         Imprisonment: 2 years to life


1,000 kg or more of marijuana or 1,000 or more marijuana plants.
Fine: $50,000                                                   Imprisonment: 20 years to life


Note
: Second or subsequent offenses result in much harsher fines and/or penalties than noted for this state.  Possession/sale/distribution of marijuana within a school zone and/or to minors results in much harsher penalties in this state.
