Unlawful possession of marijuana

A person who possesses less than 1 ounce of marijuana.
Fine: $500 to $1,000                                        Imprisonment: None


Unlawful sale/delivery of marijuana without monetary exchange

A person who distributes less than 5 grams of marijuana for no monetary exchange.
Fine: $500 to $1,000                                        Imprisonment: None

 

 
 
 

Misdemeanors

 

Unlawful possession of marijuana in a restricted area
A person who possesses less than 1 ounce of marijuana within 1,000 feet of the real property comprising a public or private elementary, secondary or career school attended primarily by minors.
Fine: Up to $500                                              Imprisonment: Up to 30 days


Unlawful sale/delivery of marijuana without monetary exchange

A person who distributes 5 grams to 1 ounce of marijuana for no monetary exchange.
Fine: Up to $5,000                                           Imprisonment: Up to 1 year


Unlawful sale of drug paraphernalia                       

It is unlawful for any person to sell or deliver, possess with intent to sell or deliver or manufacture with intent to sell or deliver drug paraphernalia, knowing that it will be used to unlawfully plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, repack, store, contain, conceal, inject, ingest, inhale or otherwise introduce into the human body any amount of marijuana.
Fine: Up to $5,000                                           Imprisonment: Up to 1 year

Unlawful possession of marijuana
A person who possesses more than 1 ounce of marijuana.
Fine: Up to $20,000                                         Imprisonment: 2 to 10 years


Unlawful sale/delivery of marijuana

Any person who knowingly sells, manufactures, delivers or brings into this state any amount of marijuana.
Fine: Up to $100,000                                       Imprisonment: Up to 10 years


Unlawful sale/delivery of marijuana to a minor

Any person who knowingly sells, manufactures, delivers or brings into this state any amount of marijuana if the delivery is to a person under 18 years of age and the defendant is at least 18 years of age and is at least three years older than the person to whom the marijuana is delivered.
Fine: Up to $100,000                                       Imprisonment: Up to 20 years


Unlawful possession/sale of marijuana in a restricted area

It is unlawful for any person to sell/deliver any amount marijuana within 1,000 feet of the real property comprising a public or private elementary, secondary or career school attended primarily by minors.

Fine: Up to $100,000                                       Imprisonment: Up to 20 years



Note
: Patients and doctors have found marijuana to be an effective treatment for suffering caused by debilitating medical conditions, and therefore, marijuana should be treated like other medicines.  Oregonians suffering from debilitating medical conditions should be allowed to use small amounts of marijuana without fear of civil or criminal penalties when their doctors advise that such use may provide a medical benefit to them and when other reasonable restrictions are met regarding that use.
