Any person who possesses 40 grams or less of marijuana.
Fine $250 to $500                    Imprisonment: MMI 1 day Up to 90 days

Unlawful possession of marijuana
Any person who possesses more than 40 grams of marijuana.
Fine: Up to $10,000                                         Imprisonment: Up to 5 years


Unlawful delivery/manufacture of marijuana

It is unlawful for any person to manufacture, deliver, or possess with intent to manufacture or deliver 40 grams or less of marijuana.
Fine: Up to $10,000                                         Imprisonment: Up to 6 months

It is unlawful for any person to manufacture, deliver, or possess with intent to manufacture or deliver more than 40 grams of marijuana.
Fine: Up to $10,000                                         Imprisonment: Up to 5 years


Unlawful distribution of marijuana to a minor

Any person who is 18 years of age or older who intentionally distributes any amount of marijuana to a person under the age of 18 years.
Fine: Double                                                     Imprisonment: Double


Unlawful sale/distribution of marijuana in a restricted area

Any person who manufactures, sells or distributes or possesses with intent to sell or distribute any amount of marijuana in a school, on a school bus, within one thousand feet of a school bus route stop designated by the school district, within one thousand feet of the perimeter of the school grounds, in a public park, in a public housing project designated by a local governing authority as a drug-free zone, on a public transit vehicle, in a public transit stop shelter, at a civic center designated as a drug-free zone by the local governing authority, or within one thousand feet of the perimeter of a facility, if the local governing authority specifically designates the one thousand foot perimeter.
Fine: Double                                                     Imprisonment: Double


Note
: Second or subsequent offenses result in much harsher fines and/or penalties than noted for this state.  Possession/sale/distribution of marijuana within a school zone and/or to minors results in much harsher penalties in this state. This state provides certain protection for users of marijuana for medical purposes with a valid prescription.
