Unlawful possession of marijuana Any person who possesses any amount of marijuana. Whenever any person who has not previously been convicted of any offense, or of any offense under any statute of the United States or of any state or of any county this person will be eligible for a conditional discharge. Upon fulfillment of the terms and conditions, the court shall discharge the person and dismiss the proceedings against him or her. There may be only one discharge and dismissal under this section with respect to any person. Fine: Up to $1,000 Imprisonment: Up to 6 months
Unlawful possession/use of drug paraphernalia It shall be unlawful for any person to use, or to possess with intent to use, drug paraphernalia to manufacture, inject, ingest, inhale, or otherwise introduce into the human body any amount of marijuana. Fine: Up to $500 Imprisonment: Up to 30 days
Unlawful sale of drug paraphernalia A person who delivers or sells, possesses with the intent to deliver or sell, or manufactures with the intent to deliver or sell any drug paraphernalia, knowing, or under circumstances where one reasonably should know, that it will be used to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, prepare, test, analyze, pack, repack, store, contain, conceal, inject, ingest, inhale or otherwise introduce into the human body any amount of marijuana. Fine: Up to $1,000 Imprisonment: Up to 90 days
Unlawful sale of drug paraphernalia to a minor Any person 17 years of age or over who delivers or sells, possesses with the intent to deliver or sell, or manufactures with the intent to deliver or sell any drug paraphernalia, knowing, or under circumstances where one reasonably should know, that it will be used to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, prepare, test, analyze, pack, repack, store, contain, conceal, inject, ingest, inhale or otherwise introduce into the human body any amount of marijuana to a person 17 years of age or under who is at least 3 years younger than the violator. Fine: Up to $10,000 Imprisonment: Up to 9 months

Unlawful possession of marijuana (2nd offense) Any person who possesses any amount of marijuana with a prior conviction for the same offense. Fine: Up to $10,000 Imprisonment: Up to 3.5 years
Unlawful sale of marijuana Any person who manufactures, distributes, or delivers less than 200 grams of marijuana or 1 to 4 plants. Fine: Up to $10,000 Imprisonment: Up to 3.5 years
More than 200 grams, but less than 1,000 grams or 5 to 20 marijuana plants. Fine: Up to $10,000 Imprisonment: Up to 6 years
More than 1,000 grams, but less than 2,500 grams or 21 to 50 marijuana plants. Fine: Up to $25,000 Imprisonment: Up to 10 years
More than 2,500 grams, but less than 10,000 grams or 51 to 200 marijuana plants.

Unlawful sale of marijuana in a restricted area Any person who manufactures, distributes, or delivers marijuana in or on, or within 1,000 feet of the real property comprising a state, county, city, village or town park, a jail or correctional facility, a multi-unit public housing project, a swimming pool open to members of the public, a youth center or a community center, any private or public school premises, or a school bus. Fine: Varies Imprisonment: Up to an additional 5 years
