Unlawful possession of marijuana Any person who possesses less than 3 ounces of marijuana. Whenever any person who has not previously been convicted of any offense, or of any offense under any statute of the United States or of any state or of any county this person will be eligible for a conditional discharge. Upon fulfillment of the terms and conditions, the court shall discharge the person and dismiss the proceedings against him or her. There may be only one discharge and dismissal under this section with respect to any person. Fine: Up to $1,000 Imprisonment: Up to 1 year
Unlawful cultivation of marijuana Any person who knowingly or intentionally plants, cultivates, harvests, dries, or processes any amount of marijuana. Fine: Up to $1,000 Imprisonment: Up to 6 months
Unlawful sale of drug paraphernalia A person who delivers or sells, possesses with the intent to deliver or sell, or manufactures with the intent to deliver or sell any drug paraphernalia, knowing, or under circumstances where one reasonably should know, that it will be used to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, prepare, test, analyze, pack, repack, store, contain, conceal, inject, ingest, inhale or otherwise introduce into the human body any amount of marijuana. Fine: Up to $750 Imprisonment: Up to 6 months
Felonies
Unlawful possession of marijuana Any person who possesses more than 3 ounces of marijuana. Whenever any person who has not previously been convicted of any offense, or of any offense under any statute of the United States or of any state or of any county this person will be eligible for a conditional discharge. Unlawful sale of marijuana Any person who manufactures, distributes, or delivers any amount of marijuana. Fine: Up to $10,000 Imprisonment: Up to 10 years
Unlawful sale of marijuana to a minor Any person who is 18 years of age or older at the time of the distribution upon which the conviction is based, and the person to whom the marijuana was distributed was under the age of 18 years or who is at least 3 years younger than the violator at the time of the distribution. Fine: Varies Imprisonment: Double
Unlawful sale of marijuana in a restricted area Any person who manufactures, distributes, or delivers marijuana in the boundaries of or within 500 feet of the boundaries of real property used by a school district primarily for the education of any student in any grade from kindergarten through twelfth grade. (Mandatory 2-year prison sentence running consecutively to prison term imposed for violating other drug sale laws).
Fine: Up to an additional $1,000 Imprisonment: MMI 2 years

Unlawful sale of drug paraphernalia to a minor
Any person 18 years of age or over who delivers or sells, possesses with the intent to deliver or sell, or manufactures with the intent to deliver or sell any drug paraphernalia, knowing, or under circumstances where one reasonably should know, that it will be used to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, prepare, test, analyze, pack, repack, store, contain, conceal, inject, ingest, inhale or otherwise introduce into the human body any amount of marijuana to any minor. Fine: Up to $2,500 Imprisonment: Up to 5 years
Note: Second or subsequent offenses result in much harsher fines and/or penalties than noted for this state. Possession/sale/distribution of marijuana within a school zone and/or to minors results in much harsher penalties in this state.
